Where is Gender Selection Legal?

By Brandie Umar - Executive Director of Content | April 25th, 2011

First lets start out with the basics for those who might not be familiar with the definition of gender selection.

Gender selection is often referred to, as family balancing or sex selection; it is the attempt to control the gender of a baby to achieve the desired sex.

In the past 10 years we have begun to realize that the concept of building a family is no longer a simple bond between 2 people.  The process of having children and creating a family has formed into a complexity of tests, hormone levels, DNA, and designer babies in some cases.

Boy or Girl?  It’s human nature to seek out choices for every decision we make and now that applies to having children. With these choices come very controversial and ethical issues regarding gender selection.

Many countries have made it illegal, some countries choose to not comment on the topic, and some even promote it.

According to the International Federation of Fertility Societies Surveillance 2010, who surveyed 105 countries, gender selection by either sperm sorting techniques and/or embryo biopsy is allowed by statute in only 15 countries, not allowed in 43 and not mentioned in law in 15, but is practiced by one or both techniques in 26 countries.

Here is a detailed graph of the locations in which gender selection is considered legal or illegal. It should help clarify which locations are available for families seeking gender selection abroad, and for families who are hoping to keep the cost of gender selection affordable by traveling overseas.

Keep in mind that the laws regarding gender selection are constantly in dispute, so before seeking options, it’s best to contact an infertility specialists in that area.
